THE WAY OUT FILM CAMPAIGN
The Lonely ones TEAM,
Our main objective is to build a project that supports the upcoming music releases and more importantly starts building more trust and a healthy relationship between JECP and The Lonely Ones. After our conversation, we're excited about the relationship and the vision, as well as the marketing potential we could create around a serious idea, but keeping it marketable and digestible for an audience with a slightly more positive takeaway, more like a romance.
The proposals below are in two camps. Our top proposal supports JECP producing two music videos for TLO and an additional micro-film series over one weekend and with a less stripped-back production. This would allow us to produce the main idea for The Way Out and a secondary video that has more emphasis on performance, thus creating more consistency in quality across upcoming releases. The second proposal is more stripped back, covering one day and focusing on The Way Out only. Either option is great, but we wanted to give options as usual.
We love this video idea and see it as a big re-investment back into JECP as it covers not only some creative formats for filming the performance but we can have fun with set design, attire, and character-building, which is a huge growth point and area we are interested in for future work. We are aware there are budgetary restrictions but we have built our proposals around our core production team, supportive lighting to make the look, and will be counting on the TLO team to work alongside us in producing!
Our biggest push will be for us to refine details from the story, characters, and a solid shot-list so we can maximize time and creativity for a $40k video instead of under $10k. Working together, getting clear on communication, and maximizing our resources will be the most significant impact on the project.
THE WAY OUT CREATIVE OVERVIEW + FUTURE PROOFING
From our call the biggest thing we feel JECP can bring to the table is strengthened cinematography, refining the art direction for the project, and setting the stage for future films to build off of characters, color, and stylistic choices.
Tackling a heavy story around suicide and keeping it digestible for marketing and viewers is the key. We want to paint a dark romance story, following characters feeling alone, yet together and letting them ascend together in a tasteful manner all while also giving a backbone to the music video for great band shots and marketing a fresher look.
Outside of a story, our hope is to bring a new look to The Lonley Ones in fashion, style, and feeling more modern and approachable to a younger audience. While the story is important, communicating a new look that supports a growing audience will be key.
In addition, Proposal one dives into talking head content where we can begin humanizing the band more and create a social release calendar for a few months, creating more opportunity for connection, taking fans behind the lyrics, meanings, and feelings that have culminated to what we see today as The Lonely Ones.
We're borrowing inspiration from a gothic, day of the dead vibe in characters, attire, and themes while splashing in some color for the band to feel less like WWE characters and a bit more approachable.
We will still use elements like haze, darker lighting, and other pieces to make the cinematography feel modern.
Our storyline characters will navigate an almost post-apocalyptic feeling setting feeling empty, but finding personal connection in each empty scenario. Theres plenty of room to explore the creativity here and refine leading to production.
The band is our main focus, as we want to reintroduce the members with a fresh new look, that feels inviting to a new audience. This will be achieved through lighting, fashion, and energy. A big changer we want to ee is more movement and flavor from each performance, pressing into a new era of The Lonely Ones, matching closer to the live energy.
We aren't married to any one place, but we do feel if we could contain this shoot to one location we can modify with lighting tricks it would make a significant impact to a better film and better used time.
We could take this to the studio at Ohio HD and create something clean and inferred in a studio, but would also be interested in finding a run-down (Colonial) or older feeling location to dress in lighting. This would let us utilize more budget towards crew and rentals than a location. Theres an art temple in Zanesville that comes to mind, but we would love to collaborate on this element to make the film a little bigger if feasible.
Creatively we would love to use a stop-motion style creative with any demons we create or the characters wrestling them, as we feel this creates an interesting look that matches past editing choices but also creates a clear differentiator to the rest of the film.
Lighting will be darker, yet add in more color than previous films. Nailing down a clear color direction will let us experiment more and we could pull inspiration from our location. For lensing, we want to shoot with something fair clean and crisp and tag on some filtration to bloom highlights. As we create the ascension scene and move into a surreal limbo we want to push brighter highlights and create a glowy feeling to push the idea more.

Every project takes a similar approach to create success. The biggest factor is staying clear and transparent in communication. Both parties want a project to work smoothly. We aim to reduce stress and answer questions, so we are in the most creative production mindset. Pre-production requires syncing everyone’s schedules, securing gear, locations, and freelancers, as well as preparing wardrobe, MU, and props. We run a tight ship with to-do’s for all parties and that’s how we deliver such consistent projects and experiences for our clients. Our ask is that clients respect the process and help us gather information and confirm along the way. Let’s make it a win-win scenario.
We love camera systems that pack a punch, move the day along with little hesitation and look beautiful. This project has a few variations that we feel the RED Scarlet 5k system will handle best. Being able to switch between 24fps for performances at the standard motion to 48fps for talent and b-roll as well as 120fps for super slow motion all while staying in 4k resolution makes this the camera of choice.
Pairing this with wireless video to the monitor will keep the day moving fast. We're either going to add anamorphic lensing or filtration for the flaring and softness in examples for a top tier cinematic feel.
We are keeping the lighting kit simple, lightweight, and packaged for travel. This will keep the project moving fast, allow more creative control, and let everyone work comfortably.
We run our sets on a clean and fast time frame. We ask that clients be respectful of the schedule, but understanding that perfection can take time. Work with us, and we will all create the best project. We try to stay on schedule while being open to ideas that can make the project its best.
Internally we work through our rough cut to a fine cut for clients to fast track a single set of revisions. We can prioritize one piece over the other into a list we work down. 30-60 days turnaround time with one round of revisions. Bills at $100/hr with additional revisions.

Panic! At the Disco | Emperor's New Clothes
One thing we noticed from the Eternal Sadness video was the usage of sped-up footage and instantly thought that would be a great effect to polish and embed as a creative decision for this upcoming video. This video showcases the singer in a sped-up, surreal fashion evolving into the monster. Utilizing this effect is challenging, but a way we could differentiate and create something memorable.
The Lonely Ones | Eternal Sadness
The tone of this video is great and there are several pieces we feel are still strong for building upon The Lonely Ones brand value. Character creation is strong and the story branches wide. Our focus will be to tighten story, implement more lighting tricks and focus on creative cinematography to build upon this style and create a more universe driven approach for future films.

In taking on this project at a discounted rate, we want to clarify why, deeper than doing a favor. In producing this production, we hope to earn your trust and create a behind-the-scenes vlog that helps exemplify how complex productions are actually created. We will be using the BTS as marketing and educational-based content.
We are viewing this production as an opportunity to re-invest in JECP’s marketing material over business growth. We will be using the agreed-upon rate to cover the base cost of operations, our freelancer rates, and aid in marketing efforts. Your contribution is in providing us new work and impacting how other artists learn from us and creatives we help grow in the creative community.
The money we are removing from the cost directly impacts reduced crew rates by 17%, Jr Editor for free, Pre-production for free, Post Production finishing for free, leaving hard costs of production and location/rentals non-negotiable items to make this project a reality.

SCOPE OF WORK
Each project has it’s a combination of services and these are expectations of each body of work:
All video work created by JECP will be of high resolution in formats accepted and optimized for various platforms; social, web, broadcast, and streaming. Delivered through dropbox for smoother sharing of content. These specifications are in relationship to your proposal/package attached to this contract.
All photo work created by JECP will be of high resolution in formats accepted and optimized for various platforms; social, web, design, and print. Delivered through dropbox for smoother sharing of content. These specifications are in relationship to your proposal/package attached to this contract.
All design work created by JECP will be of high resolution in formats accepted and optimized for various platforms; social, web, design, animation, and print. Delivered through dropbox for smoother sharing of content.
JECP knows each project tool is important, but the primary tool for making each one successful comes from communication. With great communication, these all work together or separately at their maximum ability. Strategy and communication come together and execute through the above tools. This is a group effort. We promise to communicate clearly, directly, and with care. In return, we ask you to share those same qualities.
With production, we will implement problem-solving, remain safe, and ensure everyone is informed throughout the production. We will assign and Project Manager/Director/Producer who will be a key point of contact throughout your day. It is expected that the day's schedule is respected and both parties come prepared on the day of production.
Our deadline will be met unless communicated beforehand in relation to the agreed package. We run an internal rough cut, before fine-tuning our project to the fine cut is first to see our client's eyes. We award one round of clear revisions and fast track the process after for a quick final cut. Additional revisions land at $100/hr for further tuning.
In addition to the projects fees, you will be responsible for certain disbursements, expenses, and other costs JECP incurs in connection with this agreement, in the following circumstances:
If a person in relation to the client doesn't respect property, JECP, equipment, or crew and it results in physical damage or injury, the client is responsible for 100% of the cost resulted.
Be nice. Be respectful. Collaborate. If these simple ideas are followed there is nothing to worry about. Accidents happen, malicious acts are not accepted.
Unless special arrangements are otherwise made in writing, fees and expenses of others will be your responsibility and will be billed directly to you. These costs will be approved by you, in writing, in advance of being incurred. You will be invoiced for all reimbursable expenses, together with appropriate documentation evidencing such expenses. Reimbursable expenses shall be paid by you within 14 days of the date of invoice.
Our packages cover production and post-production. Additional fees in location, talent, props, etc will be billed separately from the package unless specified with your Project Manager. This information is within the proposal.
JECP utilizes a 25/50/25 payment agreement for projects. This structure is 25% down to secure your proposed project/treatment and draw up this service agreement. This is non-refundable after paid. An additional 50% is due 14 days before the production date. Once the two-week window is entered this payment is non-refundable/non-negotiable. The final 25% is due on a net 30 days after the production date and is non-negotiable. This protects our business, define clear rules, and are meant to make the payment process structured.
All invoicing is through PayPal from email@example.com These invoices are shareable, can be paid in partial amounts, and meant to keep the sales process convenient. We accept PayPal, PayPal financing, credit/debit cards, cash + check. Checks are made out to
J. Emerick Cinema & Photo, LLC or Josh Emerick.
We send out google calendar invites for the due dates of payment, the amount due and a link directly to your PayPal invoice for automated collections.
LATE PAYMENT PENALTY
JECP reserves the right to impose an interest charge equal to 5% on any fees or invoiced reimbursable expenses that remain unpaid after 7 days. Every 7 days that past result in an additional 5%.
CONDITIONS TO OUR SERVICE OF PERFORMANCE
Prior to commencing the performance of services, you agree to first:
Designate a primary point of contact who is responsible for decisions
and for answering and resolving questions and issues: JOSH EMERICK
We need cooperation, communication, the reason for our understanding of creation/strategy, and for the client to follow the plan of the proposed project.
In order for JECP to perform services for you in an effective and efficient manner, you agree to:
Provide all information, content, and documentation that JECP may request from you or that may otherwise be useful to us in connection with the performance of services; and
Immediately advise JECP of any changes to your operations or other information that may require a change in the scope or particulars of the services.
If you want to increase or decrease the scope of the services described above, or want to add additional services, JECP requires that any such changes be mutually agreed to in writing and attached to this agreement as an addendum.
HANDLING OF DISPUTES
This agreement will be governed by and construed in accordance with the laws of OH. Any dispute that arises relating to this agreement shall be settled by arbitration in Columbus, OH, in accordance with the rules of the American Arbitration Association, provided that discovery shall be governed by the civil procedure rules of OH or any successor statute, and judgment upon the award rendered may be entered in any court having jurisdiction. You agree to waive any objection to the jurisdiction of such a venue.
Notwithstanding the preceding paragraph, with respect to the collection of past due to monies that you owe to JECP in accordance with the terms of this letter agreement equal to or less than the jurisdictional limit for small claims court in OH, JECP shall be permitted, in JECP's sole discretion, to bring a summary proceeding against you in such court and you agree to waive any objection to personal jurisdiction or venue, and any right to a trial before a jury, in any proceeding in these courts. You agree to pay all costs and expenses, including but not limited to; reasonable attorney fees and court costs, for the collection and/or enforcement of any obligation under this agreement, whether or not a lawsuit or arbitration is commenced.
This agreement will continue until completion of the services unless terminated earlier by either party upon 30 days advance written notice. Should either party terminate this agreement prior to the end of the term, you will pay to JECP the unpaid portion of fees for services that were performed, plus all unpaid reimbursable expenses.
Notwithstanding the previous paragraph, if you intentionally or repeatedly do not abide by these terms, and the situation is not resolved within 10 days of receiving written notification from JECP, we reserve the right to end the project immediately.
Independent contractors are variables we consider with every project and fast communication is absolutely needed in order to serve those relationships with proper respect.
This agreement shall only be amended upon the written approval of both parties. The client is not permitted to assign your rights, duties, or obligations under this agreement to any other party without JECP's prior written consent.
This agreement constitutes the entire agreement between the client and JECP with respect to the performance of the services set forth above. This agreement supersedes any previous agreements between these parties relating to the performance of these services.
