PARADISE FILM CAMPAIGN

HI dark island TEAM,

Our main objective is to build a project that supports the upcoming marketing plans and more importantly starts building trust and a healthy relationship between JECP and Dark Island. Ross and I have been eager to work with DI since late last year when we first connected and we've been optimistic about transforming this relationship to the next level. We view each artist as a win-win opportunity to grow and artists and help make great visuals as well as a focused marketing strategy for their fan base.

 

The proposals below are creatively satisfying and with varied budgets and levels of involvement. Please review, gather questions, and after revision let's book a call to discuss which option feels best for Dark Islands' upcoming marketing efforts!

OVERVIEW

Our goal with this music video proposal is to make a visually interesting, yet logistically simple and cost-effective music video, that remains on-brand with Dark Island. While the main project at hand is one music video (Paradise) production, below we’ve listed one option that proposes what it would look like to knock out two in a day, lengthening the visual side of DI’s 2021 marketing efforts.

Still keeping things simple and practical on the production side either way.

The other options priced out are for a few different working efforts. Review with any questions!

Proposal 1 - This proposal covers two full music videos and traditional deliverables to support totaling 63+ assets. It's doable with a fuller crew and managing time by scaling up.

Proposal 2 - This proposal is optional to cover the music video more fully. It totals in 30+ deliverables assets.

Proposal 3 - This proposal is one music video only, making it a singular deliverable project, focused on affordability and hiring us for production only with a music video deliverable and not the body of work deliverables. This is in an effort to start somewhere affordable with a marketing strategy outside of our scope.

Proposal 4 - This proposal covers a simple performance-heavy music video to support the single with me as a team of one and to get something done with way less budget and deliverables. I wanted to include this to cover bases and show that I ultimately want to bridge the relationship in one capacity or another.

CREATIVE

PARADISE CREATIVE

At the core of each proposal is a music video for Paradise. In general, we picked up on a few things from the song and feel a few pieces are crucial in any proposal. Depending on which route we go we can determine how we navigate the creative process together.

The song is upbeat and feels like strong single material. With that, we know the main focus should be great shots of the band in strong lighting and showcasing fashion and energy. The previous video falls a little flat here, on the most marketable piece of the group, yourselves.

The song's tone feels upbeat yet the lyrics feel more mundane and sad, lending this project to a nice juxtaposition whether through lighting, set design, characters, or emotion. Depending on how our creative kick-off goes we can define what makes the most sense and lands best for creative.

As far as color and lighting go I see a variant in brighter frames and darker frames in the film and playing into a few hues of blue from lighter to darker and splashing in accent colors, potentially pink, yellow, or red.

SECONDARY MUSIC VIDEO (PROPOSAL ONE)

This is a dealers choice project. If you had another track that was ready to go we could include it into the package and focus on a strong performance video with standard motion and slow motion and utilizing you as the characters to build something that is simple, but pretty. Again the creative would need refinement, but I would want o borrow color or mood to bridge the gap between Paradise and even Nervous to make this film feel a part of the Dark Island catalog and universe. 

MATCHING PROMO PHOTOGRAPHY

We are always trying to snag quick images from set that help to release content and feel more on brand. Once we lock in creative and on set lighting, we would make sure to snag simple promos from the set for additional marketing support. This is a quick way to add value on set without added time or costs.

HOW WE DO,

WHAT WE DO

PROCESS

Every project takes a similar approach to create success. The biggest factor is staying clear and transparent in communication. Both parties want a project to work smoothly. We aim to reduce stress and answer questions, so we are in the most creative production mindset. Pre-production requires syncing everyone’s schedules, securing gear, locations, and freelancers, as well as preparing wardrobe, MU, and props. We run a tight ship with to-do’s for all parties and that’s how we deliver such consistent projects and experiences for our clients. Our ask is that clients respect the process and help us gather information and confirm along the way.  Let’s make it a win-win scenario.

CAMERA DETAILS

We love camera systems that pack a punch, move the day along with little hesitation and look beautiful. This project has a few variations that we feel the RED Scarlet 5k system will handle best. Being able to switch between 24fps for performances at the standard motion to 48fps for talent and b-roll as well as 120fps for super slow motion all while staying in 4k resolution makes this the camera of choice.

 

Pairing this with wireless video to the monitor will keep the day moving fast. We're either going to add anamorphic lensing or filtration for the flaring and softness in examples for a top tier cinematic feel.

LIGHTING

We are keeping the lighting kit simple, lightweight, and packaged for travel. This will keep the project moving fast, allow more creative control, and let everyone work comfortably. 

SHOOT DAY

We run our sets on a clean and fast time frame. We ask that clients be respectful of the schedule, but understanding that perfection can take time. Work with us, and we will all create the best project. We try to stay on schedule while being open to ideas that can make the project its best.

POST PRODUCTION

Internally we work through our rough cut to a fine cut for clients to fast track a single set of revisions. We can prioritize one piece over the other into a list we work down. 30-60 days turnaround time with one round of revisions. Bills at $100/hr with additional revisions.

HLH | PEAK FOCUS PROJECT

This video combines great visual language, lighting, and energy in a simple format with an easy-to-digest story. This is similar to the format we are producing with more emphasis on the band and a little story with consistent colors and lighting, making the band's performance the epic portion of the project.

Joji | Story and Art

One thing that sticks out in the Paradise track and this music video is juxtaposition. The panda dancing at the beginning with everyone dead relays happiness in sadness in one setting. I think finding a way to bridge this gap through lighting, actions, emotions, and body language could be a good way to compliment Paradise's upbeat vibe, but slightly less upbeat lyrical aspects.

HLH | GREAT PERFORMANCE STRUCTURE

This video is a bit dated but what stands out to us is doing a simpler option to keep costs down by focusing on a great performance from the band and less on the story, making it clear that we are marketing a great song performed by a solid band. This would be a good viable approach for the two lower proposals (3 + 4)

CLIENT NOTE

In taking on this project at a discounted rate, we want to clarify why, deeper than doing a favor. In producing this production, we hope to earn your trust and create a behind-the-scenes vlog that helps exemplify how simple productions still have moving parts and can be produced high end. So we will be using the BTS as marketing and educational-based content.

 

We are viewing this production as an opportunity to re-invest in JECP’s marketing material over business growth. We will be using the agreed-upon rate to cover the base cost of operations, our freelancer rates, and aid in marketing efforts. Your contribution is in providing us new work and impacting how other artists learn from us and creatives we help grow in the creative community. 

 

The money we are removing from the cost directly impacts reduced crew rates by 17%, Jr Editor for free, Pre-production for free, Post Production finishing for free (associated to PROPOSAL ONE - THREE), leaving hard costs of production and location/rentals non-negotiable items to make this project a reality.

TERMS

SERVICE AGREEMENT

We are pleased that you have selected JECP LLC to assist you with branding services. 

 

When awarding us your project you are investing in the future of a small business, continuing our operations, providing jobs for freelancers, and giving us an opportunity to be a part of your music career. We love the work we do, appreciate the artists who trust us, and want to keep moving this business forward. It’s our honor to serve you.

SCOPE OF WORK

Each project has it’s a combination of services and these are expectations of each body of work:

 

Video 

All video work created by JECP will be of high resolution in formats accepted and optimized for various platforms; social, web, broadcast, and streaming. Delivered through dropbox for smoother sharing of content. These specifications are in relationship to your proposal/package attached to this contract.

Photo 

All photo work created by JECP will be of high resolution in formats accepted and optimized for various platforms; social, web, design, and print. Delivered through dropbox for smoother sharing of content. These specifications are in relationship to your proposal/package attached to this contract.

Design 

All design work created by JECP will be of high resolution in formats accepted and optimized for various platforms; social, web, design, animation, and print. Delivered through dropbox for smoother sharing of content.

Strategy/Communication

JECP knows each project tool is important, but the primary tool for making each one successful comes from communication. With great communication, these all work together or separately at their maximum ability. Strategy and communication come together and execute through the above tools. This is a group effort. We promise to communicate clearly, directly, and with care. In return, we ask you to share those same qualities.

Production

With production, we will implement problem-solving, remain safe, and ensure everyone is informed throughout the production. We will assign and Project Manager/Director/Producer who will be a key point of contact throughout your day. It is expected that the day's schedule is respected and both parties come prepared on the day of production.

Post-Production

Our deadline will be met unless communicated beforehand in relation to the agreed package. We run an internal rough cut, before fine-tuning our project to the fine cut is first to see our client's eyes. We award one round of clear revisions and fast track the process after for a quick final cut. Additional revisions land at $100/hr for further tuning.

 

EXPENSES

In addition to the projects fees, you will be responsible for certain disbursements, expenses, and other costs JECP incurs in connection with this agreement, in the following circumstances:

 

If a person in relation to the client doesn't respect property, JECP, equipment, or crew and it results in physical damage or injury, the client is responsible for 100% of the cost resulted. 

 

Be nice. Be respectful. Collaborate. If these simple ideas are followed there is nothing to worry about. Accidents happen, malicious acts are not accepted.

 

Unless special arrangements are otherwise made in writing, fees and expenses of others will be your responsibility and will be billed directly to you. These costs will be approved by you, in writing, in advance of being incurred. You will be invoiced for all reimbursable expenses, together with appropriate documentation evidencing such expenses. Reimbursable expenses shall be paid by you within 14 days of the date of invoice.

 

Our packages cover production and post-production. Additional fees in location, talent, props, etc will be billed separately from the package unless specified with your Project Manager. This information is within the proposal.

 

PAYMENT STRUCTURE

JECP utilizes a 25/50/25 payment agreement for projects. This structure is 25% down to secure your proposed project/treatment and draw up this service agreement. This is non-refundable after paid. An additional 50% is due 14 days before the production date. Once the two-week window is entered this payment is non-refundable/non-negotiable. The final 25% is due on a net 30 days after the production date and is non-negotiable. This protects our business, define clear rules, and are meant to make the payment process structured.

 

All invoicing is through PayPal from staycreative@jemerickcinemaphoto.com These invoices are shareable, can be paid in partial amounts, and meant to keep the sales process convenient. We accept PayPal, PayPal financing, credit/debit cards, cash + check. Checks are made out to 

J. Emerick Cinema & Photo, LLC or Josh Emerick.

 

We send out google calendar invites for the due dates of payment, the amount due and a link directly to your PayPal invoice for automated collections.

 

LATE PAYMENT PENALTY

JECP reserves the right to impose an interest charge equal to 5% on any fees or invoiced reimbursable expenses that remain unpaid after 7 days. Every 7 days that past result in an additional 5%. 

 

CONDITIONS TO OUR SERVICE OF PERFORMANCE

Prior to commencing the performance of services, you agree to first: 

 

Designate a primary point of contact who is responsible for decisions 

and for answering and resolving questions and issues: JOSH EMERICK

We need cooperation, communication, the reason for our understanding of creation/strategy, and for the client to follow the plan of the proposed project. 

 

In order for JECP to perform services for you in an effective and efficient manner, you agree to:

 

Provide all information, content, and documentation that JECP may request from you or that may otherwise be useful to us in connection with the performance of services; and 

 

Immediately advise JECP of any changes to your operations or other information that may require a change in the scope or particulars of the services. 

 

If you want to increase or decrease the scope of the services described above, or want to add additional services, JECP requires that any such changes be mutually agreed to in writing and attached to this agreement as an addendum.

 

HANDLING OF DISPUTES

This agreement will be governed by and construed in accordance with the laws of OH. Any dispute that arises relating to this agreement shall be settled by arbitration in Columbus, OH, in accordance with the rules of the American Arbitration Association, provided that discovery shall be governed by the civil procedure rules of OH or any successor statute, and judgment upon the award rendered may be entered in any court having jurisdiction. You agree to waive any objection to the jurisdiction of such a venue.

 

Notwithstanding the preceding paragraph, with respect to the collection of past due to monies that you owe to JECP in accordance with the terms of this letter agreement equal to or less than the jurisdictional limit for small claims court in OH, JECP shall be permitted, in JECP's sole discretion, to bring a summary proceeding against you in such court and you agree to waive any objection to personal jurisdiction or venue, and any right to a trial before a jury, in any proceeding in these courts. You agree to pay all costs and expenses, including but not limited to; reasonable attorney fees and court costs, for the collection and/or enforcement of any obligation under this agreement, whether or not a lawsuit or arbitration is commenced.

 

TERMINATION

This agreement will continue until completion of the services unless terminated earlier by either party upon 30 days advance written notice. Should either party terminate this agreement prior to the end of the term, you will pay to JECP the unpaid portion of fees for services that were performed, plus all unpaid reimbursable expenses.

 

Notwithstanding the previous paragraph, if you intentionally or repeatedly do not abide by these terms, and the situation is not resolved within 10 days of receiving written notification from JECP, we reserve the right to end the project immediately.

 

Independent contractors are variables we consider with every project and fast communication is absolutely needed in order to serve those relationships with proper respect. 

 

 

 

INDEPENDENT CONTRACTOR

This agreement shall only be amended upon the written approval of both parties. The client is not permitted to assign your rights, duties, or obligations under this agreement to any other party without JECP's prior written consent.

 

This agreement constitutes the entire agreement between the client and JECP with respect to the performance of the services set forth above. This agreement supersedes any previous agreements between these parties relating to the performance of these services.

 

Clients Acknowledgement

Client certifies that they have read and agree with the preceding Disclaimer.
